There are a few things to consider when signing recording contracts. You will need to be alert or you will find yourself bound up in an unfavorable agreement for quite some time. This industry is a large one and has its share of crooks who will readily take advantage of someone who is new to the game. The best course of action is to hire a lawyer who can help you. Here are some steps to help you choose the lawyer that is right for you.

1.Search for an attorney: Look up entertainment lawyers, attorneys or recording contracts in Google. You will find several websites with some interesting and useful information. Check out the websites carefully and pay attention to details. Note down some names and get ready to dig deeper.

2.Check their expertise: They should specialize in music business contracts, be aware of the ins and outs of the agreement, and be well familiar with this typical law. Reading through the articles on their website will give you a good indication on their expertise. Be careful to note all the information that you find and make small thumbnail sketches of your selected attorneys.

3.Check out testimonials and previous work: On any good website you will find testimonials. These are valuable insights into who the lawyer has worked for and what they have been involved in.

4.Rapport-needed to get on well with them: Whenever you hire a lawyer to write up a recording contract you should always make initial contact by phone. This will answer immediate questions and give you an indication of how they will respond. A free initial consultation is always good because then you will be able to judge whether you will be able to work with them.

Hiring one of these lawyers will be part of your long term goals for your music career, so you do not want to make any mistakes. This agreement may be your first but with a good lawyer on your side you can look forward to many more. This means that you will be looking for a long term business relationship with your attorney.

5.Check your budget: Before you sign any type of music business contract you will need to check your budget. You do not want to hire cheap inferior entertainment lawyers but at the same time you will need to be sure that you can afford to pay your lawyer. As mentioned you want to hire your lawyer as a long term arrangement and you will want to be sure that money is not an obstacle.

There are many uses for Music Business Contracts. They can be used for live performances in concerts and on stage, or even in private parties and clubs. TV and radio are another place they can be utilized. The film industry is another way these agreements will be used.

It is very important to know exactly what you are getting into and having one of these agreements will safeguard your interests. It is wise to familiarize yourself with what this agreement entails by taking a look at some examples. If you want to take a look at some of these agreements, samples can be found online.

Music Industry Contracts for live performance agreements: This is a common use of these agreements. Although many of these agreements can be worked out verbally it is good to use a legal agreement in writing if possible. This will protect you from any misunderstandings, or sudden changes.

Some important questions should be considered consider when signing an agreement for a live performance are:

How you will be compensated? There are 3 basic ways to be paid;
A fee or lump sum
A portion of the ticket sales
A predetermined fee and a portion of the ticket sales

Who is hiring you? An important part of the Entertainment contract will be determining who will be hiring you. This will usually be a promoter or the venue. If the promoter belongs to the venue then you will only have to pay his fees. if he is from a third party you may have to pay both the venue and the promoter. It is wise to straighten this out so that you do not find yourself paying large amounts in fees.

Which person is signing the agreement? As a solo artist, just starting out this will very likely be you. if you have a group or band then one person from the group is usually designated to sign for all the members. A manager can also perform this service.

Sales and your rights: A well written Music Industry Contract will help to sort out what portion of the sales you will receive and what the club may get. If you are lucky you will get the entire profits from the CDs, DVDs etc that can be made and sold from your live performance. However the club may also request commissions of up to 40%.

Conditions for cancellations: it is important to understand about cancellations and to try to make sure that you can get some money if the show is canceled. The amount of money, if any , that you will receive will depend how badly the club wants your services.

A Recording Contract is an artist’s best friend. There are so many reasons to get an agreement in writing with your prospective employer. Admittedly if you are a virtually unknown band trying to get a gig from a rather reluctant club, it may be difficult to negotiate something in writing.

On the other hand it is quite amazing to know that there are many performers who let things slide with just a verbal agreement and make no attempt to get a written agreement. This is asking for trouble and is something you should really try to avoid. Here are some reasons to have a written agreement.

Copyright protection: When you sign your first Recording Contracts it is important to understand the fine print. In this way you will protect yourself and, if applicable, your band. As mentioned, many times in the performing arts, a verbal agreement is made. The results are often devastating to you the artist.

If it not in writing you do not have any legal rights and you can easily lose your copyrights to your popular hit songs. This will result in 100’s and even 1000’s of dollars loss for you and your band. However once you tie the company down to a contract you can keep your copyrights and have everything clearly stated. You get your royalties and the company can still make money.

Cuts down misunderstandings: Music Contracts ensure that you can reference any clause that you or the company may not remember. Over the course of time you or the company may not remember every single clause in your mutual agreement.

Having it in writing will allow one or both of you to refresh yourselves as to the terms of the agreement. A verbal agreement can lead to misunderstandings and disputes, as one party will deny what the other one has said. Disputes in turn can get ugly and cost you the engagement..

The legal word in Recording Contracts: If anything needs to be disputed in court it will need to be in writing. No court of law will accept any statement unless it is in writing. Of course you will not want to take matters into court if possible but sometimes it is unavoidable.

Of course it is much easier to understand the clauses in the agreement when it is in writing. So do not let the company or club run over you, try to get it in writing to avoid any future problems.

I woke up early this morning for some reason. Maybe it was a car that passed through the neighborhood or a dog barking that woke me or maybe it was the hand of the muse pushing me to get out of bed and see what she wanted me to see but, either way, I woke up early and I have been rewarded for the experience.

Part of my morning routine includes stepping outside to get some fresh air, drink a soda and make sure the world has survived another night of BP oil spills, terrorist attacks and politicians. Usually, I make my morning status check of the world an hour or so later when the sun is in the sky and the whole neighborhood is awake and moving but this morning I got to experience something totally unique…

As I stepped onto the front step, the sun was just starting to come up. The neighborhood was silent. No kids playing. No cars on the streets. Just silence. As I watched the beautiful night sky transforming into a multi colored sunrise, it was like watching one of the great artists at work, transforming colors and lines to create beauty.

The only thing missing, in my thought, was some great song, like the Sprach Zara Thrusta, to accompany this sunrise. Then, something else began to slowly dawn on me…. What I had perceived as silence before had sound all along. The change of the bird songs, the sounds of the occasional dog or cat and the slowly growing sound of a city waking up as the sun rose higher into the sky. After listening to the music created in the silence, I don’t think there is another song that could have been more perfect for the sunrise.

British born American Composer, Leopold Stokowski was once quoted to say “A painter paints his pictures on canvas. But musicians paint their pictures on silence. We provide the music, and you provide the silence.” I think a lot of us miss the impact of those words when we get involved in creating music. Sometimes, just taking that moment to reconnect and flush out all the noise in our heads and let the silence in is the best thing we can do for our music.

So I have a little challenge for all of you songwriters out there. Before you write your next song, or even if you’re working on one you can’t seem to get just right, set your alarm clocks and wake up with the sunrise. Go outside and just spend an hour watching God paint the sky while nature provides the music of silence.

It’s a rewarding experience that will help you clear your mind and come back to your work with some fresh ears and a fresh way of thinking. When you take the time to reconnect with the world around you and see the world through different eyes, it’s going to show in your music.

I look forward to hearing about your experience. Please leave comments and let me know how this works out for you and your thoughts. What other ways do you use to clear your mind and write great music?

Some people have a knack for song structure. Taylor Swift, for example, began by writing poetry as a child. After teaching herself to play the guitar she began putting her poems to music, structuring them as songs. Of course, not everyone has Taylor’s innate musical skills. At the same time, you don’t need to attend college and earn a music degree or take years of lessons to learn the basics of how to create the perfect structure for your songs.

What does song structure actually mean? Structure refers to the way the sections of the song are arranged. Structure gives the song its form and optimizes the emotional or musical impact. Different genres of music have different structure. For example, a symphony has a different structure that a pop song. An R&B ballad has a different structure than a rap. So the type of genre you write in will affect the ultimate structure of your song.

Typically, songs employ repetition to make them catchy and to emphasize the song’s emotional point. Structure is also used to enhance the story telling element of a song, making the listener want to hear what’s coming next.

Before you can decide on the structure of your song, you need to know the components to use.

The Introduction: Usually an instrumental using chords from the verse or chorus but famous lyricists like George Gershwin regularly started his compositions with a sung intro.

Verse: Usually contains four to 8 chords. In songwriting terms, the story of the song is told through the verses.

Chorus: Also called the refrain, the chorus is also usually four to eight chords and has a primary musical phrase which is repeated. In Red Hot Chili Peppers’ “Dani California,” the refrain is:

California rest in peace
Simultaneous release
California show your teeth
She’s my priestess, I’m your priest

The chorus as a distinctly different musical dynamic that the verses. In songwriting terms, this is the emotional center of the song. Typically, a phrase from the chorus is what people remember.

Bridge: The bridge is a musical connection between the verses and the chorus of a song. It can be used to smooth the transition between key or tempo changes, making the song have a smoother flow.

Middle 8: A musical or lyrical interlude that can prevent a song from seeming monotonous or to add a different emotional element.

Outro: The “bow out” of a song. Often it’s just a reiteration of the verse or chorus but can be totally unique. The elements of structure are just a guideline. How you use them is based on your talent and artistic vision.

Other than street performers who get to keep all the money they collect in their hat, very few songwriters and composures get to retain the rights to their work. Labels emerged as a way to promote and distribute and artist’s music on a regional then national and international scope.

In return, they required music creators to give up a certain percentage of their intellectual property. Years ago performers had very few options because the way the industry was structured it was extremely difficult to become successful without a label because they controlled distribution.

As a result of their monopoly, over the years there have been many cases of labels demanding most or all of the song rights in order for an artist or band to get a record deal. And the performers were desperate enough for success that they agreed. Then later, once they became successful, the performers would sue to get out of their contracts but still would not recoup any money. So there is a very good reason why you should never sell full rights to your songs: the label and publisher will get rich while you continue to scrape by.

In no other field is an artist expected to give up rights as they are in the music business. Even in book publishing, where authors may initially give up 85% of their initial sales royalties to a publisher, after 10 years ALL the rights revert back to the author. That is not the case in the music industry. So the best way to have rights to your songs ten years down the road is to not sign them away to begin with.

While the traditional music labels continue to ask for a lion’s share of the rights when signing new acts, smaller independents are offering performers more favorable deals. For example, a new label named Polyphonic lets its artists keep their copyright and will share profits from touring and recording 50-50 with the artist.

The catch is: in exchange for retaining the copyright, the band has to be hands-on in its promotion and marketing. Polyphonic gives bands $300,000 in seed money to record their songs and plan tour dates. The primary target are bands will smaller but solid fan bases who can sell 80,000 – 100,000 units – a small amount of sales by major label standards but for a business model like Polyphonic a nice business for it and the performers.

In the haste to reach the top of the music charts, many musicians will run right past a huge windfall of money without ever blinking an eye. That windfall is the Royalty Check.

What’s a Royalty Check?

In many intellectual industries, like writing, art or music, a royalty is paid to the creator of the work. In the music world, the royalty is a percentage of the money earned from the sale or use of a song or CD.

To understand why royalties are important, let’s take for example that you signed a contract allowing a producer to distribute your song via digital mp3 downloads and pay you 1% of the profits as royalties over your lifetime. Just for the simplicity of the figure, let’s assume he charges customers $1each to download the song.

At first it doesn’t sound like much. You made a penny because someone downloaded your song. Ok, now let’s assume this song just became a number one hit and it gets download one million times this week. That’s 1,000,000 pennies sitting in your royalty coffers… $10,000 for doing nothing more than recording one song and letting someone else market it for you. It’s easy to understand how important getting these royalty checks could be to a musicians financial stability.

It’s also easy to understand why the big recording labels might try to leave them out of your contract. It can and does happen. Historical examples of this kind of dirty dealing include accounts such as when Bethlehem Records bought the rights to the Nina Simone album “Little Boy Blue” for $3,000. If Mrs.Simone had retained her royalty rights, the album would have earned her well over $1 million in royalties.

It’s no big secret, the trick of how to start a record label definitely involves some cash and most definitely involves some talent. If you want to know the secret to how to start and run your own label then here it is, talent. You have to have something to sell your business pitch with. It doesn’t matter what your particular genre is, you need to get out there and discover your first million. Yep, I am talking about dollars.

If you are just sitting around trying to figure out how to start you own independent record label then you are wasting your time. Get out there and try to find “the” band or “the” person that is worthy of a record deal. Go to clubs, rummage through MySpace, hang out at bars with live music, there is talent all around you so find it.

Do you have friends or a band already in mind? If you do then you are one step ahead of the “how to start a record label” game. Two or three bands would really be optimal when beginning your own record label. For those of you who don’t have someone in mind, then you have some work to do.

A good way to search for talent is to have an idea of what you are looking for. If you are going to learn how to start and run your own record label then you must be able to find the gap. There is a gap somewhere and you need to find it. Keep in mind, you are searching for someone who is marketable, a true money maker.

If you can’t quite pinpoint a gap, then identify a target market you think you can penetrate and go for it. Who would have thought that the Backstreet Boys or 98 Degrees would have made it big? Well, the guys from their record label were definitely on to something. Teenage girls were where it was at and boy did those guys stumble on to something big and man did they make a profit! Believe me, that is your first step in how to start a record label.

Just like with any other business, you are going to have to sell your product. And you can’t sell your product until you have your product. So, this is your first lesson in how to start your own independent record label. In this business, you are going to have to think outside the box and when you do that, you will be ready to start your own record label.

One of the keys to your success as a musician is, knowing how to start your own record label. Sometimes this can be quite a challenge you will need to think carefully and long term before taking any decisions. Your name will in effect be your business name and as such it will need to be:

Unique: Not only should your business name be unique you should also try not to make it similar to large well known businesses.

Memorable: You want your business name to be easy to remember. If you make it to the top of the charts you will want to be sure that your name is catchy enough to be remembered and become a household name.

Describe who you are as a musician starting your own record label. You need to stand out as a musician and your name should personify what you and your music stand for.

Budgeting: When you begin your business, remember that no business can be run without financial backing. If you do not have some money set aside for your business, you are setting yourself up for failure. It is imperative for your success that you put some thought into this and make a monthly budget for your business before you begin. Try to keep business expenses separate from personal ones.

Make it legal: Licensing your business name is mandatory when you start your own record label. You should always remember to license it with the city or state registrar. This will ensure that you do not infringe on copyrights and that your name cannot be used by anybody else. For a little extra they can also search and see that nobody else has the same name.

This is a useful thing to do as you do not want to get into any copyright problems later on. Once you have an established brand name you do not want to change it. Additionally getting a retail license, or permit is necessary if you are planning on selling recordings.

Multiple artists: When you start your own record label you have an option to publish other musicians’ works under your label. This is not a bad idea as you will then be sure to get some money coming in if your music is not going so well. You can join the ASCAP or BMI as a publisher or songwriter. This will help you to expand your brand name and develop your business.
